The Dish Forum User Agreement applies to the SoapSaver auction site, as well as the following:
Right to Suspend or Terminate
You agree that the administrator or moderators of The Dish Forum, at their discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this website; (b) You have violated the user agreement or terms & conditions; (c) You have listed a suspicious or illegal item; or (d) We believe you to be a non paying bidder. In most cases when we suspect rule violations or suspicious activity, we will suspend your account/listing whilst we investigate further. If our investigation is conclusive, your account with us will be terminated. Rule violations at the SoapSaver auction site may result in suspension or termination of your Dish Forum account, and vice versa.
Your Conduct
You are solely responsible for the contents of your actions through this website, as well as your comments, questions, and feeback to others. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation. The Dish Forum administrator and moderators retain discretion in interpreting the above conditions besides those having to do with applicable laws.
Membership
Membership to this website is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18) to register. If any member fails to signup with their correct age the account will be terminated immediately. Your membership is also contingent on these other conditions: That you are a registered member of The Dish Forum good standing, having registered at least three months prior to your registration at the SoapSaver site, and having at least 100 posts to your name; that you register at the SoapSaver auction site using the same username and email address as you use at The Dish Forum; and that you remain in good standing at both the SoapSaver and The Dish Forum web sites. Registrants who fail to meet the above criteria will have their accounts suspended or terminated at the discretion of The Dish Forum administrator and moderators.
Auctions and Liability
This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed; the truth or accuracy of the listings; the ability of sellers to sell items; or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretense. By registering and participating at the SoapSaver auction site, you acknowledge and accept these risks and will not hold the SoapSaver site, its administrators, its moderators, or any other Dish Forum representative liable for transactions gone bad. This website shall not be responsible for any items sold by auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer or seller. This website shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods sold, purchased or obtained. This website assumes no liability for the content of the listings, or for the conduct of its participants. However, we ask that if you fall victim to fraudulent activities here at the SoapSaver site, that you contact us regarding the matter immediately so we can take whatever actions we are able to on our end. We will try to assist you and any legal representatives or law enforcement officers in investigations of fraud to the best of our abilities. The administrator, moderators, and webmaster do not make any guarantees as to the reliability of the software used to power the SoapSaver web site, nor about the reliability of the servers and internet connections used in hosting this site. We are not responsible for any losses, financial or otherwise, due to software bugs, server outages, email not properly sent or not received, scheduled or unscheduled maintenance or downtime, account suspension or termination, or any other reason deliberate or accidental.
Responsible Auction Listing
You are responsible for the content of any auction you post. You are responsible for posting your auction in the correct category or subcategory. You are responsible for educating yourself on the auction listing procedure and options, and using them fairly and properly. All auctions listed are binding once bids have been placed. If you list an auction, you are responsible for seeing it through to a satisfactory end once bids have been placed on your item or items. If you are running a co-op, you are responsible for familiarizing yourself with the additional rules and procedures regarding co-ops and following those additional rules and procedures. You are responsible for leaving honest and accurate feedback for those you do transactions with. If you list an auction or elect to use an auction option(s) for which there is a fee, you are responsible for paying your balance due promptly upon billing. At this time Paypal is the only acceptable means of payment remittance. If this is not acceptable to you, it is your responsibility to avoid incurring fees. Alternatively, you may contact the administrator to discuss the possibility of an alternative form of payment. You are responsible for shipping out won items in a timely manner, usually within (3) business days (excluding holidays and weekends) unless you specify otherwise in your auction description. You are responsible for following all the terms and conditions listed herein and elsewhere, including but not limited to the additional rules for co-ops and The Dish Forum user agreement.
Responsible Bidding and Buying You are responsible for educating yourself fully on any item you bid on and any co-op you elect to participate in. We offer you two means of contacting a seller before making a bid: through the "ask a seller a question" feature and by private message through the forum. You are responsible for using one or both of these options if you need additional information about an auction or co-op. You are responsible for remitting payment for any bid you make that results in a won auction in a timely fashion, usually within (3) three days. If you are participating in a co-op, you are responsible for working with the host/ess to place your order and remitting your payment according to the host/ess's specifications. You are responsible for leaving honest and accurate feedback for those you do transactions with. Suppliers
The Dish Forum administrators and moderators retain sole discretion in classifying participants as suppliers or non-suppliers. By registering and participating at the SoapSaver auction site, you agree to be classified as either a supplier or non-supplier, and understand that this classification may change at our discretion. Suppliers are required to post any soapmaking, cosmetic-making, or candle-making related items; items to aide in the marketing or selling of soap, cosmetics, candles, or related products; items meant to be resold in conjunction with handmade soap, cosmetics, or candles; or any other item that you normally sell to be sold in the Supplier's Auctions category. If you list an auction or elect to use an auction option(s) for which there is a fee, you are responsible for paying your balance due promptly upon billing. Outages
From time to time there may be scheduled or unscheduled outages at the SoapSaver and The Dish Forum websites. We are not responsible for any time or revenue lost as a result of planned or unplanned outages. In the case of an outage, you may be eligible for certain credits in the case of fee-based listings that end during or shortly after an outage. In the case of an extended outage that adversely affects the bidding on your auction(s), you may be eligible for a credit as well. In the case of an outage, watch The Dish Forum for announcements. Information about any possible credits and instructions will be posted.
Spam & Inappropriate Transactions The SoapSaver web site prohibits the following: (1) Collection of email addresses or use of email addresses found at the SoapSaver or The Dish Forum sites to send unsolicited and commercial email or PMs; (2) Sending unsolicited email or PMs to underbidders offering products for sale on the part of the original seller or anyone else; (3) Offers to sell or buy an item that has been listed on SoapSaver off the SoapSaver site; (4) Use of the SoapSaver or The Dish Forum resources to conduct transactions other than through the proper channels and in accordance with the user agreement, terms & conditions, and other rules; (5) Offering to sell an item or items to a bidder in a "reserve not met" auction; or (6) any other transactions or offers for transactions that do not comply with our rules, terms & conditions or that do not follow the appropriate procedures or channels as set forth in our rules, terms & conditions.
Restricted Items
You are not permitted to sell any items that are restricted by law, contrary to law, or that encourage or enable others to break laws. You are prohibited from selling any items because of which children, animals, or other people could be injured as a result of buying, selling, shipping, or using the item. The Dish Forum administrator and moderators reserve the right to use discretion on a case by case basis as to which items are permitted for sale and which are not.
Your Privacy & Protection
You are responsible for protecting your privacy and identity. Use your discretion in choosing payment options that could be unsafe, including giving your credit card number or other sensitive information to anyone you are not comfortable doing business with. Keep in mind that certain personal information, such as your name, address, and phone number may be disclosed during the course of a transaction, and make sure conditions are comfortable for you before proceeding with transactions. While we will not knowingly disclose your personal information to third parties (unless required or necessary by law), we are not responsible for any breach of privacy that comes as a result of transactions or hacking attempts.
Auctions for Charity
We support charitable endeavors; however, to protect our members, we require that anyone listing auctions which claim to benefit charity to ensure they are. Buyers should exercise caution in transactions claiming to benefit charity; these policies are in effect for your protection, but fraud is possible regardless. Think twice before bidding much more than an item is worth on charity auctions for which you do not know and trust the seller.
Taxes, Copyrights, Intellectual Property, and other Legalities
You are required to collect and/or pay any applicable taxes according to state and federal laws where you live. You may not infringe on any copyrights, trademarks, or intellectual property laws in your transactions at the website. You are responsible for ensuring that you follow all applicable laws in your transactions and participation.
